FINDCARE4KIDS LLC – TERMS OF USE

Effective Date: November 22, 2025

These Terms of Use (“Terms”) are a legal agreement between you and FindCare4Kids LLC (“FindCare4Kids,” “we,” “us,” or “our”) and govern your access to and use of FindCare4Kids.com and all related websites, applications, and services (collectively, the “Services”).

By using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.

These Terms apply to all Users and Providers, whether or not you register for an account.

1. About the Services

FindCare4Kids is an online directory allowing mental health professionals, treatment programs, and related providers (“Providers”) to create profiles. Individuals and families (“Users”) may browse the directory and contact Providers independently.

FindCare4Kids:

  • Does not provide medical or mental health services
  • Does not give medical, clinical, or therapeutic advice
  • Does not verify or guarantee Provider qualifications, licensure, or competency
  • Does not supervise, employ, or oversee Providers
  • Does not create any clinical or professional relationship with Users

The Services are informational only.

We may update, modify, restrict, or discontinue the Services at any time without notice.

2. Eligibility

You must be at least 18 years old to use the Services independently.

If you are using the Services on behalf of a minor, you affirm you are the parent, guardian, or legally authorized representative. In that case, “you” includes both you and the minor.

The Services are not intended for unsupervised use by minors.

3. Not for Emergencies or Crisis Use

The Services are not intended for emergencies or urgent mental health situations.

If you or someone else is in crisis or danger:

  • Call 911 or your local emergency number
  • In the U.S., you may call or text 988 (Suicide & Crisis Lifeline)

Do not use FindCare4Kids for emergencies.

4. No Medical or Professional Advice

Information on the Services:

  • Is for general informational purposes
  • Is not medical or mental health advice
  • Should not be relied on for diagnosis, treatment, or clinical decisions
  • Does not replace consultation with a licensed provider

You are solely responsible for evaluating any Provider and any services you choose to engage.

5. No Professional-Patient Relationship

Your use of the Services does not create any relationship with FindCare4Kids, including:

  • Doctor–patient
  • Therapist–client
  • Clinician–patient
  • Any professional or fiduciary relationship

Any relationship forms directly between Users and Providers, outside of FindCare4Kids.

6. Provider Responsibilities

Providers are solely responsible for:

  • The accuracy of all information submitted
  • Maintaining all required licenses, certifications, and compliance
  • Providing truthful, non-misleading profile information
  • Updating content promptly if any information changes
  • Any services rendered to Users

FindCare4Kids does not guarantee that any Provider:

  • Is licensed, active, or in good standing
  • Is qualified, competent, or suitable
  • Will provide any particular outcome

Users should independently verify Provider credentials.

7. Accounts and Security

If you create an account:

  • Your information must be accurate and complete
  • You must keep your login credentials confidential
  • You are responsible for all actions under your account
  • You must notify us promptly of unauthorized access at contact@findcare4kids.com

We may refuse, suspend, or terminate accounts at our discretion.

8. Content Definitions

  • Provider Content: Information Providers submit, including profiles, descriptions, images, logos, and materials
  • User Content: Information Users submit, including inquiries and messages
  • FindCare4Kids Content: Our website design, graphics, text, branding, and other proprietary materials
  • Third-Party Content: Links, websites, and tools not controlled by FindCare4Kids

9. License Granted by Providers

By submitting Provider Content, you grant FindCare4Kids a worldwide, royalty-free, perpetual, non-exclusive, transferable, sublicensable license to:

  • Display, distribute, reproduce, host, and format your content
  • Promote and market the directory
  • Use your name, business name, logo, and related information as part of the Services

Providers represent that they own or have rights to all submitted content.

10. Content Standards

Content submitted to the Services must not:

  • Be fraudulent, misleading, or deceptive
  • Be illegal, harmful, harassing, defamatory, or obscene
  • Promote discrimination or exploitation
  • Infringe intellectual property rights
  • Misrepresent credentials, availability, or identity
  • Include unauthorized personal information
  • Be copied from other sources without permission
  • Use stolen or unauthorized photos or logos
  • Divert inquiries deceptively to unrelated parties
  • Be primarily AI-generated without human review and accuracy verification

We may remove or edit any content at our discretion.

11. Acceptable Use and Prohibited Activities

You may not:

  • Scrape, crawl, extract, copy, or harvest data
  • Use bots, automated systems, or scraping tools
  • Reverse engineer any part of the Services
  • Interfere with or disrupt servers or networks
  • Attempt unauthorized access
  • Reproduce or repurpose data to create a competing service
  • Upload viruses, malicious code, or harmful scripts
  • Use the Services for spam, solicitation, or advertising
  • Use the Services for unlawful purposes

We may investigate suspicious activity and take action as needed.

12. Third-Party Websites and Links

The Services may contain links to external websites, tools, or platforms. FindCare4Kids does not control or endorse these third-party resources and is not responsible for:

  • Their content
  • Their privacy practices
  • Their security
  • Their services or claims

Accessing external websites is at your own risk.

13. Provider Subscriptions, Billing, and Payments

If you subscribe as a Provider:

  • Subscription fees may be recurring (e.g., monthly)
  • You authorize charges to your selected payment method
  • Prices and terms may change with notice
  • Cancellation and refund terms follow our published policies
  • Failure to pay may result in suspension or removal of your listing

Actual billing details will be outlined in a separate Provider-facing agreement.

14. Intellectual Property

All FindCare4Kids Content is owned by FindCare4Kids LLC and protected by copyright, trademark, and other laws.

You may not:

  • Copy, modify, reproduce, or create derivative works
  • Use our trademarks or branding without permission
  • Remove copyright or proprietary notices

15. Copyright Complaints (DMCA Notice)

If you believe your copyrighted work has been used unlawfully on the Services, send a DMCA notice to:

Your notice must include all required DMCA elements.

16. Disclaimer of Warranties

The Services are provided “AS IS” and “AS AVAILABLE.”

We disclaim all warranties, express or implied, including:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy or completeness
  • Availability or reliability

We do not guarantee:

  • That any Provider is qualified or suitable
  • That Provider information is accurate or current
  • That Services will be uninterrupted or error-free
  • That outcomes will be achieved

Your use is at your sole risk.

17. Limitation of Liability

To the maximum extent allowed by law:

FindCare4Kids LLC and its owners, members, employees, and affiliates are not liable for any:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of data, profits, revenue, or goodwill
  • Errors or omissions in content
  • Interactions with Providers
  • Provider services, conduct, or outcomes
  • Issues caused by third-party sites

If we are found liable despite these Terms, our total aggregate liability to you will not exceed: $100 (one hundred U.S. dollars).

18. Release and Assumption of Risk

You release FindCare4Kids LLC from all claims related to:

  • Your use of the Services
  • Your interactions with Providers
  • Any services you receive or do not receive
  • Provider conduct, omissions, or actions

You understand FindCare4Kids does not supervise or verify Providers.

19. Indemnification

You agree to defend, indemnify, and hold harmless FindCare4Kids LLC from and against any claims, losses, liabilities, or expenses (including attorney fees) arising from:

  • Your use of the Services
  • Your content or conduct
  • Your interactions with Providers
  • Your violation of these Terms

20. Termination

We may suspend, restrict, or terminate your access at any time, for any reason, without liability.

We are not required to delete or return content you previously submitted.

Terms relating to disclaimers, liability limits, indemnification, and arbitration survive termination.

21. Dispute Resolution and Arbitration Agreement

21.1 Informal Resolution

Before arbitration, you must email us a written dispute notice at: contact@findcare4kids.com

We will attempt to resolve the issue within 60 days.

21.2 Binding Arbitration

Except for small claims matters, all disputes arising out of or relating to these Terms or your use of the Services will be resolved by binding arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules.

  • A single arbitrator will preside
  • The arbitration will occur in the Commonwealth of Massachusetts, unless both parties agree otherwise
  • Remote arbitration may be used if permitted by AAA rules

21.3 Class Action Waiver

You and FindCare4Kids agree that all claims must be brought only in an individual capacity.

No class actions, collective actions, or representative proceedings are permitted.

21.4 One-Year Limitation

Any claim arising from the Services must be filed within one (1) year or it is permanently barred.

22. Governing Law

Except where preempted by federal law (including the Federal Arbitration Act), these Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law rules.

23. Electronic Agreement

By using the Services or clicking “I Agree,” you:

  • Sign these Terms electronically
  • Consent to receiving notices electronically
  • Agree that electronic signatures have full legal force

24. Changes to These Terms

We may update or modify these Terms at any time. Your continued use of the Services constitutes acceptance of updated Terms.
